利用規約
株式会社アマナ（以下「当社」といいます）が開催する「IMA next」（以下「本コンテスト」といいます） には、本コンテスト利用規約（以下「本規約」といいます）に同意頂けた方のみ参加することができます。
第１条（本コンテストの参加条件）
本コンテスト応募者（以下「応募者」といいます）は、どなたでも応募することが可能です。ただし、18歳未満の方は保護者の同意を得た上で応募してください。18歳未満の方が応募された場合は、保護者の同意を得た上で応募されたものとみなします。
第２条（本コンテストへの応募作品）
本コンテストへの応募作品（以下「応募作品」といいます）は、本コンテスト応募要項に従い、応募者自身が撮影した又は応募者が著作権を有する写真のみで、且つデジタルデータにて応募するものとします。 なお、応募者は１度の応募で複数枚の組写真に応募でき、何度でも応募作品を本コンテストに応募することができます。
第３条（本コンテストの応募方法等）
１本コンテストの応募者は本コンテストの応募フォームより応募作品をアップロードの上、必要情報を入力して応募して下さい。
２応募申し込み後は、応募作品を取消又は差替えることはできません。
第４条（応募作品の無効化）
応募作品が以下各号に該当すると当社が判断した場合は、応募者が応募した全ての応募作品を無効として取扱います。
（１）公序良俗又は法令等に反するもの又は反するおそれがあると当社が判断したもの
（２）第三者の権利を侵害し又は侵害するおそれがあると当社が判断したもの
（３）有害な又は有害な結果を及ぼすおそれのあるコンピュータープログラム等を送信し又は送信するおそれのあるもの
（４）特定の人種・宗教・政治を差別し又は差別を助長すると当社が判断したもの
（５）犯罪を教唆し又は教唆するおそれがあると当社が判断したもの
（６）児童の裸体を被写体としたもの
（７）死体・汚物その他第三者に不快感を与える又は与えるおそれがあると当社が判断したもの
（８）当社及び当社の提供するサービス又は信用を失墜・毀損すると当社が判断したもの
（９）当社が不適切と判断したもの
第５条（遵守事項）
応募者は、応募作品につき以下の事項を遵守しなければなりません。なお、本条に定める遵守事項に違反した又は違反するおそれがあると当社が判断した場合は、応募者が応募した全ての応募作品を選考対象から除外するものとします。
（１）応募作品が応募者が権利を有する写真であること。
（２）応募作品そのもの及び同作品の撮影に関し、第三者の権利を侵害していないものであること。
第６条（応募作品の権利帰属）
１応募作品の著作権は、原則的に応募者に帰属するものとします。
２応募者は、本コンテスト応募期間終了日までに応募した作品につき、当社の裁量において、本コンテスト応募サイト及び、浅間国際フォトフェスティバル公式サイトでのみ掲載されることに予め同意します。
３前項にかかわらず、本コンテストに入賞又は入選した応募作品については、浅間国際フォトフェスティバル2026での作品展示並びに、本コンテストの実施及び運営のために当社が応募作品を複製し又はトリミング等の改変をし、当社の裁量で使用期間及び使用媒体に制限なく使用することに予め同意します。
４応募者は、当社に対して応募作品における著作者人格権を行使しないものとします。
第７条（応募作品の知的財産権）
１応募者は、応募作品に第三者が権利を有するもの（商標権・意匠権、著作権を含むがこれらに限らない。以下同じ）が含まれる場合、正当な権利者から使用許諾を得ることを含む一切の権利処理を行ったうえで本コンテストに応募したことを当社に表明し且つ保証するものとします。
２応募者が前項の表明保証に違反し、第三者から応募作品の使用差止、異議、請求、何らかの主張又は裁判上の請求等を受けた場合、応募者は当社及び第三者が蒙った損害の一切を賠償する義務を負うことに同意します。
第８条（賞品）
１入賞者には、 当社より応募者のメールアドレスに連絡し、応募者から賞品の送付先の開示があった場合に、当該送付先宛に発送します。
２賞品を受領する権利は入賞者のみに帰属し、賞品受領権を第三者に譲渡し又は担保に供することはできません。
第９条（本コンテストの一時停止等）
１当社は、当社システムの保守・点検・障害等を含む当社の裁量及び判断により、応募者に事前に通知することなく本コンテストを一時停止・中断し又は延期しもしくは中止することができます。
２前項の場合、当社は応募者の蒙った損害を賠償する責任を負いません。
第10条（免責）
１応募者は、以下各号に定める義務等から当社を免責することに予め同意します。
（１）応募者が本コンテストに応募するに当たり要する通信機器またはソフトウェアとの互換性を確保するために、当社が有する又は管理する設備、システムまたはソフトウェアを改造、変更、追加する義務
（２）応募者により応募作品のアップロード中における事故及びデータの全部又は一部の破損・滅失等に関する損害賠償義務
（３）応募者が期待する応募作品の商品的価値・有用性の保証義務
２本コンテスト及び応募作品に基づき又は関連し、応募者と第三者との間で起きた紛争等につき、その原因及び理由の如何を問わず応募者は当社を一切免責し、当該紛争等は応募者の責任及び負担において解決するものとします。
第11条（個人情報）
１本コンテスト参加により当社が取得した個人情報は、当社が別途定める「情報セキュリティ基本方針」及び関連法令に基づき管理します。
２当社が別途定める「個人情報の利用目的」の範囲においてのみ使用します。

第12条（本規約の変更）
当社は、応募者に事前に通知することなく、本規約を変更することができます。変更後の利用規約は、本コンテストの応募サイトに掲載された時点において効力を有します。
第13条（分離可能性）
本規約のいずれかの条項またはその一部が法令等により無効または執行不能と判断された場合であっても、本規約のその他の規定は継続して完全に効力を有するものとします。
第14条（準拠法及び裁判管轄）
本規約は日本法に準拠し、本規約に基づく訴訟の第一審の専属的合意管轄裁判所は東京地方裁判所とします。
第15条（提供地域）
当社は、本コンテストを通じて、EEA域内の方に商品・サービスを提供せず、また、 EEA域内の方の行動を、cookie等により監視することも致しません。

In IMA next (hereinafter referred to as the “Contest”), which is organized by amana inc. (hereinafter referred to as the “Company”), only those that have agreed to the terms of use of the Contest (hereinafter referred to as the “Terms of Use”) will be eligible to participate.
Article 1: Conditions of participation for contest
Applicants to this contest (hereinafter referred to as “Applicants”) may be anyone. However, those under the age of 18 must obtain the consent of a parent or guardian before applying. If an applicant under the age of 18 submits an entry, it will be deemed that the application was made with such consent.
Article 2: Work to Apply to Enter the Contest
A piece of work to apply to enter the Contest (hereinafter referred to as the “Application Work”) shall be submitted using only a photo taken by the Applicant or a photo to which the Applicant owns the copyright according to the application guidelines of the Contest, and digital data. The Applicant may submit multiple photos in a single application and may submit the Application Work to the Contest multiple times.
Article 3: Application Process for the Contest
1Entries will only be accepted via the entry form on the this website.Please upload your works using the form and enter the required information to submit your application.
2After the application is submitted, the Applicant Work may not be redacted or replaced.
Article 4: Ineligibility of Application Work
If the Company has decided that the Application Work falls under any of the following items, all the Application Works submitted by the Applicant will be treated as ineligible.
(1)The Company has decided that it is or could be against public order and decency or laws or regulations.
(2)The Company has decided that it infringes or could infringe on a third party’s rights.
(3)It sends or could send a computer program that is harmful or could have harmful consequences.
(4)The Company has decided that it discriminates or will promote discrimination against a certain race, religion or political party.
(5)The Company has decided that it abets or could abet a crime.
(6)The naked body of a child is the object of the piece.
(7)The Company has decided that it provides or could provide a sense of discomfort to a third party, such as a dead body or a dirty item.
(8)The Company has decided that it will ruin or damage services provided by the Company or the credibility of the Company.
(9)Those that are deemed inappropriate by the Company
Article 5: Matters to be Complied With
The Applicant must comply with the following matters with respect to the Application Work. If the Company has decided that the Applicant violates or could violate the matters to be complied with provided for in this Article, the Company shall exclude all the Application Works submitted by the Applicant from the selection.
(1)The Application Work is a photo to which the Applicant owns the rights.
(2)A third party’s rights are not infringed on in relation to the Application Work itself and the photographing of the Application Work.
Article 6: Attribution of Rights of Application Work
1The copyright of the Application Work shall belong to the Applicant, in principle.
2 Applicants agree in advance that the works they submit by the end of the contest application period may, at the discretion of the Company, be posted only on the Contest application website and the official Asama International Photo Festival website.
3Notwithstanding the preceding paragraph, Applicants agree in advance that, with respect to works that have won prizes or been selected in this contest, the Company may reproduce, crop, or otherwise modify such works as necessary for the implementation and operation of the contest, and may use them at its discretion without limitation as to the period of use or the media of use.
4Applicants agree not to assert any moral rights of authorship in relation to their submitted works against the Company.
Article 7: Intellectual Property Rights of Application Work
1If the Application Work includes the rights of a third party (including, but not limited to, trademark rights, design rights and copyrights; the same shall apply hereinafter), the Applicant shall give the Company representation and warranty that the Applicant applied for the Contest after addressing any and all rights, including the acquisition of a license from the legitimate right holders.
2The Applicant shall agree that if he/she violates the representation and warranty in the preceding paragraph and receives a request for the suspension of use of the Application Work, an objection, a request or a claim from a third party, or a judicial claim, the Applicant will be liable for compensation of any and all damages suffered by the Company and the third party.
Article 8: Prize
1The prize winner shall be contacted by the Company at his/her e-mail address, and if the Applicant discloses the shipping address of the prize, it shall be shipped to the shipping address.
2The right to receive the prize shall belong only to the prize winner, which may not be transferred to a third party or offered as security.
3Prize money for winners will be paid by bank transfer.
Article 9: Temporary Suspension of the Contest
1The Company may temporarily suspend, discontinue, postpone or cancel the Contest without prior notice to the Applicants at the Company’s own discretion and judgment on the grounds of the maintenance, inspection and failure of the Company’s system.
2In the case set forth in the preceding paragraph, the Company shall not be liable for damages suffered by the Applicants.
Article 10: Exemptions
1The Applicant shall agree in advance to exempt the Company from obligations set forth in the following items.
(1)Obligation to refurbish, change and add equipment, systems or software owned or managed by the Company in order for the Applicant to ensure compatibility with communication equipment or software to apply for the Contest
(2)Liability for damages in relation to an accident and the breakage or loss of all or part of the data during the uploading of the Application Work by the Applicant
(3)Obligation to guarantee the commercial value and usability of the Application Work expected by the Applicant
2The Applicant shall exempt the Company from an obligation to resolve any and all disputes arising between the Applicant and a third party based on or in relation to the Contest and the Application Work, whatever the case and the reason may be, and the said disputes shall be resolved at the Applicant’s own risk and expense.
Article 11: Personal Information
1) All personal information collected by the Company from the participation of individuals in this Contest will be handled in accordance with the "Basic Guidelines on Information Security" separately set forth by the Company as well as all related laws and regulations.
2) This personal information will only be used for the purposes of running this Contest and will be promptly deleted after the required period of time has elapsed.
Article 12: Revision of the Terms of Use
The Company may revise the Terms of Use without prior notice to the Applicants. The revised Terms of Use shall become effective when it is posted on the application site for the Contest.
Article 13: Severability
In the event that any provision in this Agreement is found to be invalid or unenforceable under the law, either wholly or in part, all remaining provisions in this Agreement shall remain in full effect.
Article 14: Governing Law and Jurisdiction
The Terms of Use shall be governed by the laws of Japan, and any disputes arising from the Terms of Use shall be exclusively brought before the Tokyo District Court of Japan as the court of first instance.
Article 15: Service Area
Through this contest (IMA NEXT), we will not offer any goods or services to people within the EEA and will not monitor the behavior of people in the EEA through the use of cookies, etc.
